General sales conditions PROTOXIDE
Please read these sales and delivery conditions carefully, as only those written in Italian are considered valid, since other sales conditions written in other languages are only for comprehension aid and are the result of translations that may be incorrect or outdated.
In general:
These sales conditions are the only ones recognized by PROTOXIDE of Tiziano Perfetti (hereinafter PROTOXIDE), for all commercial transactions, unless specific written conditions are agreed upon for exceptional reasons.
1-Prices:
All prices indicated by us are unitary, ex our point of sale, and in Euro currency. The prices indicated in written offers, sent by mail, newsletter, email, or fax, have limited validity. PROTOXIDE reserves the right to revise the communicated or displayed prices due to supply issues or fluctuations in official exchange rates or currency quotation changes, while still notifying the customer, who has the right to cancel the order without any penalty.
2-Orders:
Orders can be placed by phone, fax, or email or by using our Online Store.
Orders must clearly indicate the name or company name of the ordering party, tax code or VAT number, telephone contact, and postal address, plus any special delivery methods, desired delivery date, and preferred carrier, and must obviously all be truthful. Incomplete orders will not be considered.
PROTOXIDE reserves the right to request order confirmation, with a deposit or advance payment of the material, depending on the ordered product. We inform you that any shipments on delivery not collected will cancel the possibility of ordering again, as non-payment of a shipment on delivery entails costs to return the shipment to our headquarters, and our system automatically places the customer on a "blacklist". For this reason, there will be no way to place future orders, not even with advance payment.
Order confirmations requested by the customer are not binding if the ordered materials are not in stock.
The minimum order quantities are binding and are indicated in any offers and order confirmations; in the absence of indications, the minimum quantity is understood as a single piece for stock materials and the linear meter for cables, sleeves, tubes, and similar.
3-Delivery and order fulfillment:
Delivery will take place according to the methods agreed upon at the time of the order. In the absence of agreements, we will proceed with the shipment according to the methods we deem most suitable.
Orders will be fulfilled as soon as possible. In case of temporary unavailability of some items, we reserve the right to delay delivery until the material is available. If the wait is too long, we will inform the Customer, who may decide in the meantime to send the available goods. If some order items are no longer available due to obsolescence or discontinued production, we reserve the right to consider the orders fulfilled. Furthermore, we remind you that all orders are entrusted to couriers, and PROTOXIDE is not responsible for any damage, delivery delays, or loss of material; therefore, the goods travel at the risk and expense of the recipient/customer. The delivery times indicated in the products are for indicative purposes only, as they may be incorrect due to direct sales in-store and unupdated warehouse stocks; for this reason, the indicated times MUST NOT BE ABSOLUTELY BINDING, nor can the arrival date be guaranteed for this reason.
4-Defect of materials, incorrect delivery, and damages:
The customer is required to check the goods upon delivery. The customer has 14 days to file a complaint for defects in the goods or incorrect delivery, missing goods inside the package, after which the goods will be considered accepted, and no further complaints will be considered.
In case of acceptance of the complaint by our sales office, the return of the goods must be agreed upon with our "shipping and returns department". PROTOXIDE will arrange for the replacement as soon as possible.
For goods ordered incorrectly, the same conditions apply, except for transport, which must take place in free port.
In case of damage to the goods due to transport, the customer is required to report it immediately to the carrier (enter the wording damaged package in the appropriate field).
Protoxide is not responsible for damages due to the transport of goods, even if carried out by couriers chosen by us. It is possible to add insurance coverage to the package, but it must be requested at the time of order, and the cost of this service, which varies based on the amount to be insured for the ordered material, must be paid.
5-Right of withdrawal and refusal of ordered goods, Returns:
As provided by the current European regulations regarding mail-order sales, the private customer (not a VAT holder) but also the same company that makes a mail-order purchase has the right to withdraw from the purchase within 14 (fourteen) days from the day of receipt of the goods, giving timely written communication with ProtoXide, via Registered Mail, email, contact form, PEC, although we always suggest better to call. Otherwise, they will not be accepted and will be returned to the sender.
In case of voluntary withdrawal (change of mind or incorrect order by the customer) only the cost of the purchased product will be refunded, the initial shipping costs incurred for sending the order will not be refunded, and the shipping costs for returning the product will always be borne by the customer, regardless of the reason for the voluntary return. The customer has the right by law to return the goods intact, NEVER INSTALLED. It is reminded that the material must be in the condition as received, so they must be in the usual new condition, including packaging, never previously installed, and even more so for electronic parts. (It must be like new to be resold to a new customer clearly as new, and not as used or used only once or tried to be installed).
An exception is made if the customer or company decides to order choosing a product that at the time of order is not available, easily identifiable as it does not have the wording next to the photo, NORMALLY SHIPPED IN 24 HOURS or in any case requires the production of the piece as it is not available in stock, the customer takes a binding commitment "exclusive" with ProtoXide, therefore if the same decides later to cancel the order for any reason, or once received wants to return it for any reason, there can be no term of refusal of goods, or return, as the goods have been handcrafted and made to your specific request, under the specific indications and needs requested.
Exceptions – Defective or non-compliant products or products received with errors or negligence attributable to ProtoXide or in case of damaged or defective product, or not compliant with the received order, all shipping costs (initial and return) will be borne by ProtoXide. The customer must report the problem in this case within 48 hours of delivery, providing photographic or video evidence of the defect/damage.
Additional shipping costs: any additional costs arising from the choice of optional services other than standard shipping (e.g., express shipping, cash on delivery, insurance, credit card payment fees, or other methods, special packaging) will not be refunded. Return costs: the shipping costs for returning the product are always borne by the customer, regardless of the reason for voluntary withdrawal, unless otherwise agreed in writing. The refund will be made within 14 days of receiving the returned product, only if NEVER USED, after verifying its integrity and compliance, using the same payment method chosen by the customer, unless otherwise agreed.
Returns from abroad not collected at customs: if the goods shipped to a foreign country return to ProtoXide because the customer did not collect the package at customs or refused to pay any customs duties and clearance costs, all costs incurred for the return of the package will be deducted from the refund.
The refund will be made within 7 days of receiving and verifying the returned product, using the same payment method chosen by the customer at the time of order, unless otherwise agreed in writing.
Beyond 14 days, no replacement is possible; therefore, it is mandatory not to send packages back without our confirmation and RMA number (useful in case of problems or repair) to be requested in advance MANDATORILY via email or phone.
The right of withdrawal can be exercised only on intact, unused, and uninstalled products.
Any product that is mounted, installed, put into operation, tested on the vehicle, or shows signs of use cannot be returned or refunded, as it is no longer resalable as new.
In particular, returns are not allowed in the following cases:

components installed even temporarily on the vehicle;

products that have undergone modifications, adaptations, or processing;
-
items damaged during installation or use;
-
electrical or electronic parts after opening the package (for technical and safety reasons).

6-Warranty:
PROTOXIDE distributes and sells the components described in the invoice for use in vehicles and/or engines designed and built by people not associated with and/or controlled by Protoxide. Therefore, no specific use of the same is recommended or contemplated since the conditions of use of such components could create very severe stresses or problems on them or other parts beyond any possible prediction. Protoxide distributes and sells these products without any commercial or technical warranty, and therefore no express or implied warranty accompanies these products, and the buyer and/or user, having checked these components, is the only one to decide how and where to use them in their designed application, assuming with the installation of these components all risks, as well as possible and eventual lost profits or sales, losses, costs of substitute goods or services, business interruptions, damages to things or people or animals or any direct, indirect, incidental, patrimonial damages that may result, therefore Protoxide does not accept any charge due to defects in the delivered materials or related processing performed to install our components.
We remind you that ALL our products are to be used exclusively on competition vehicles and where the regulations allow them, therefore they are not approved for road use and absolutely must not be installed to replace original parts on road vehicles, as the only prerogative and objective of our products is exclusively to provide better "performances" at the expense of everything else, such as reduced durability, increased noise, increased overheating, increased vibrations, increased consumption, etc., therefore the customer accepts it in full.
The customer assumes the responsibility of verifying the applicability of the purchased product concerning the use for which it will be used; if there is a defect from new, the customer must report it to us immediately, before installing it, not after installing it so that we can fix or replace it as soon as possible, receiving it back first to verify what is claimed. Therefore, in these cases, we can always replace it after receiving and testing it in our on-site laboratory, but it is not possible to claim anything as a possible cost such as non-use, disassembly, and reassembly due to, or other accessory costs incurred as fundamental preparation and knowledge is necessary, which only the installer/preparer/workshop must possess, and for this reason, we inform you that no cost will be borne by you.
Materials sourced from the market on behalf of the customer (those not present in our online catalog and requested under your indication) are supplied without any warranty and are provided as they are, and no complaints about the quality of these last components are accepted. (oxidation, lack of documentation, lack of packaging, finish, etc.)
Materials sent to manufacturers or service providers for repairs, treatments, or warranty replacements always travel at the risk and expense of the customer.
All products to be refunded must be NEVER INSTALLED AND RESALABLE AS NEW. In case someone purchases and tries to install new ProtoXide products on their vehicle to verify if the problem or fault disappears, especially as sensors or other components, we remind you that once removed from the sealed package and used, THEY CANNOT BE RETURNED OR REFUNDED. Therefore, you have 14 days after receiving the product to return it freely without having to indicate any reason, but it is necessary that the product has never been opened from the package or tried on the vehicle.
Protoxide products are mostly recognizable with screen-printed writings on them or with labels or on the packages themselves. The alteration or removal of such writings or logos by the reseller/user will result in Protoxide not recognizing any assistance, warranty, repair, or other problem encountered.
7-Availability:
The availability of materials is understood as subject to sale, holidays, and unforeseen events, unless otherwise indicated in the offer or order confirmation.
8-Payments:
The payment methods are defined before the delivery of the material. Generally, advance bank transfer, credit card transaction, or many other electronic payments are preferred. In addition, for amounts less than 990 euros, it is possible to request payment on delivery in cash only in Italy, via express courier, as the courier does not accept checks. In any case, before the order confirmation, all payment options accepted by us will be automatically suggested to you.
Failure to cancel an order or rejection of a cash on delivery shipment authorizes the suspension of our supplies. Further future supplies must be authorized by our administration office and must in any case be paid in advance before any delivery.
9-VAT exemptions and exports:
Goods destined for export to non-EU countries are regulated by the current regulations in force. The customer who wishes to take advantage of the VAT exemption must send us a copy of the declaration of intent before the delivery of the goods.
Goods purchased directly by non-EU citizens or companies must be paid in advance by bank transfer or credit card.
10- Technical support, manuals, software, and assistance on our products and orders:
Those who purchase directly from ProtoXide will enjoy dedicated professional technical-commercial support, which will allow them to be in direct contact with our staff and always know more about the purchased product. This support includes exclusive installation manuals and ProtoXide software that are exclusive to the direct buyer and the related purchased product, which is why you may be asked for the purchase invoice proving the actual purchase.
Consequently, Protoxide cannot provide any type of assistance, installation manuals, or technical support on material not purchased directly from ProtoXide, the same applies to material purchased, for example, as "used material or presumed gifted or installed at the XXX Workshop".
If the material was purchased from a Dealer, Preparer, workshop, or forum representative, it will be the latter to inform you and possibly relate to you through our ProtoXide technical department, precisely because the existing relationship is unique and direct with whoever made the purchase and is the invoice holder. Therefore, we cannot provide any type of technical support, advice, email responses, installation manuals, order status information, photos, or anything else if the order was not made directly to ProtoXide. This is to avoid having to often employ double resources and easy misunderstandings, we cannot even respond to questions like "I purchased through the XXX dealer I would like to know the status of my order, or how to install the purchased control unit....etc", if the order was made through a dealer or preparer or forum, they will relate exclusively with you. If you want to relate with us, receive targeted technical responses, installation manuals, or post-sales technical-commercial support, the only way is to PURCHASE DIRECTLY YOURSELF, through our multilingual shop, phone orders, email orders, and not through other intermediaries.
This Protoxide support indeed adds significant value to the purchased product, both when its installation requires specialized technical information or especially when the same product can also be found at other competing retailers, but may have very different installations and uses based on the desired applications, and only thanks to our suggestions matured from our experience, we can suggest the correct technical information for installation and use to achieve the best results and free from any initial and future problems.
11-Personal data:
The data provided by the customer for billing are considered correct, even if the billing computer systems indicate any errors. The customer is required to verify himself and promptly communicate any errors in the personal data. The customer is also required to promptly communicate in writing (mail or fax) any changes in personal data and the truthfulness of the data entered .
PROTOXIDE cannot be held responsible for any misunderstandings or inconveniences arising from the use of incorrect personal data provided by the customer.
Connections to the PROTOXIDE site do not take place through a secure connection (SSL), except for the credit card transaction, which is managed directly on a secure server by Setefi (Gruppo Banca Intesa).
PROTOXIDE assumes no responsibility for data provided via the internet (order form and quotation form) or by email.
12-Personal data processing:
The processing of personal data takes place using manual, computer, and telematic means with the methods provided and in any case with all necessary precautions to ensure the protection of information and its confidentiality. Personal data are processed by PROTOXIDE for purposes related to its activity and therefore to the issuance of documents and communications related to commercial relationships.
According to article 13 of law 675/1996, the interested party has the right to know the existence of an archive containing their personal data, the use that PROTOXIDE makes of their data, the deletion of their data from the archives, except those necessary for legal and fiscal purposes and all those rights that law 675/1996 grants them.

13-Acceptance of rules:
The issuance of an order or a quotation request to PROTOXIDE, even written, telephone, or verbal made by any means, implicitly indicates acceptance of all the conditions indicated on this page.

These conditions are completed by the pages on our services, the materials handled, and the price lists.
All trademarks handled by PROTOXIDE are the exclusive property of their respective owners.
The countries of origin, given the particular nature of the goods handled, are not identifiable unless clearly indicated on the materials themselves. PROTOXIDE assumes no responsibility for indications given by third parties.
